Ben Jenkins

Partner & Head of Commercial Litigation

Ben is head of the Firm’s Commercial Litigation team across our offices in Cardiff and Newport. He has developed specialisms in construction disputes, injunctive relief, partnership and Director/Shareholders’ disputes, commercial property disputes, breach of contract disputes, defamation and professional negligence actions, including advocacy at court and mediation.

Ben’s clients include PLCs and international companies, charities, professional sportspeople and professional sports clubs, as well as UK wide accountants and insolvency practitioners.

Ben has been ranked by Chambers & Partners, and his work in the area of Commercial Litigation is consistently recognised by Legal 500. Some quotations from those publications appear below.

Successfully resisted an injunction and substantial damages claim on behalf of a group of stockbrokers in London, following a claim by their former employer that they had breached their restrictive covenants (2018)

Successful defamation claim after 3 day Trial (April 2019)
Water Treatment Products Limited v Scott [2019] EWHC 1777 (Ch)
Success at a Trial to recover commission owed to an IFA after over 3 years of litigation (March 2021).
Settled a significant, complex claim involving inter-company loans on very favourable terms for his client (the other side’s acceptance of a Part 36 Offer made in 2016) just before Trial in London (May 2021).
Assisted a company client successfully and completely resist a multi-party application for an Injunction in the High Court for trespass and significant damages. Our client’s costs were paid in full (2022)
Successfully obtained an anonymity Order, expedited Trial and an Injunction acting for several Claimants in a complex privacy and harassment claim against numerous Defendants (2022)
Successfully recovered a sum in excess of six-figures for a commercial landlord, following  litigation against a former commercial tenant for the unlawful removal of goods, dilapidations and other breaches of a lease (2022)
Resolution of a complex construction dispute on very favourable terms. This came after years of litigation, following the Defendant’s acceptance of a Part 36 offer that was 3 years old (2022)
Successfully advised a large, corporate client that was the victim of fraud at the hands of an “electricity broker” worth £80,000 a month (and quickly exceeded £1million), with threats of disconnection that would have had a catastrophic impact on their business (2023)
Successfully settled a claim on favourable terms for a specialist manufacturer of machinery in relation to allegations that a bespoke piece of equipment they produced worth over £250,000.00 was faulty (2023)
Resolution of a complex, long running partnership and shareholder dispute for in excess of £800,000, plus various property transfers and a company share buyback (2024)
