Water Treatment Products Limited v Scott [2019] EWHC 1777 (Ch)

Ben acted for Water Treatment Products Limited (“WTP”) in its successful claim against Mr Scott, a former Director and Shareholder of WTP.

WTP’s primary claim was for damages, costs and interest (together exceeding a significant sum) pursuant to an indemnity in a Share Purchase Agreement between WTP and Mr Scott.

The High Court held that, after years of litigation and detailed consideration of the construction of the Share Purchase Agreement, WTP was entitled to the indemnity it sought and that the Defendant should pay its substantial costs associated with the litigation. Mr Scott was refused permission to appeal by the Trial Judge and the Court of Appeal refused Mr Scott’s application for permission to appeal.
