Road Traffic Accident Claim Changes

  • Your accident happened on or after 31st May 2021 and
  • You were inside a vehicle and
  • You are making a personal injury claim for whiplash and other minor injury which is valued at under £5,000 and
  • You are aged 18 or over when commencing the claim.

  • Your accident happened before 30th May 2021.

OR

  • Your accident happened on or after 31st May and
    • (i) You are a vulnerable road user i.e. a motorcyclist, pillion passenger, passenger in a sidecar attached to a motorcycle, wheelchair or powered wheelchair user, on a mobility scooter, on a bicycle or other pedal cycle, riding a horse or a pedestrian; or
    • (ii) You are a protected party i.e. under the age of 18 years or a party who lacks capacity to conduct proceedings unaided; or
    • (iii) Your injury claim is valued at over £5,000, or together with other financial losses your claim is valued at over £10,000; or
    • (iv) The “at fault” vehicle is registered outside the United Kingdom; or
    • (v) Your claim is in respect of a breach of duty owed to a road user by a person who is not a road user; or
    • (vi) Your claim is against an untraced driver; or
    • (vii) You or the defendant is a personal representative of a deceased person; or
    • (viii) You are currently bankrupt.
