The Small Claim Limit Is Set To Become Big

Do you have a good money claim against another party worth between £5,000.01 and £10,000? If so, now is the time to consider court action! As part of the Jackson Reforms, the upper limit of the small claims bracket is set to increase from £5,000.01 to £10,000.01 on 1 April 2013.

If the total value of your claim comes within the “small claims bracket” and you successfully sue the other party in court, it is very unlikely that the “losing” party would be ordered to make a payment towards your legal costs. If the value of your claim is in excess of the small claims bracket, the “loser” would most likely be ordered to make a payment towards your legal costs. If you get going in March you can win your claim and your costs, but come April you can only win your claim.

You should also be aware that the government has indicated that it plans a further increase of the small claims bracket upper limit to £15,000.01 after fully evaluating the initial increase.
