Power of attorney

In October 2007 Enduring Powers of Attorney (EPAs) were replaced by Lasting Powers of Attorney (LPAs).

Image - Signing formThis does not mean that existing Enduring Powers of Attorney are not valid and, if a person who has executed an EPA has lost the capacity to deal with their property and affairs, we are able to act on your behalf in connection with the formal registration of the EPA document with the Court of Protection.

There are 2 types of LPA; a Property & Affairs LPA which allows appointed attorney(s) to deal with a persons financial and property interests, and a Personal Welfare LPA which allows the appointed attorney(s) to make decisions relating to a persons welfare i.e. in relation to where they should live or medical treatment that they should or should not receive.

We are able to advise clients on the nature and effects of granting such a power along with the carrying out of the necessary registration formalities with the Office of the Public Guardian so that the LPA can then be used.
