Time Limits

Image - Hour glassGenerally, legal action must be commence within three years of the treatment error or claimants suspicion that there may have been negligent treatment. However there are certain circumstances where this may not be the case.

If the claim involves children under 18 then the claim must be made before their 21st birthday.

If there was a death due to clinical or dental negligence then the claim must be made within three years of the date of death. 

If the claimant is suffering from a recognised disability (for example, brain damage, such as cerebral palsy) then there may be no time limit to make the claim.

Whatever type of limitation is applicable, if you suspect that you may be eligible to make a claim in respect of a medical error, it must be done as soon as possible as investigating the claim could be a lengthy process.
